Terms of service
These terms cover this website and, together with the written proposal you receive, the work Zylosend does for clients. Where a signed proposal or agreement says something different, the proposal wins.
Using this site
Everything on zylosend.com, including the copy, design, code and captures of the work we have shipped, belongs to Zylosend or to the clients it was made for. You may look, link and share; you may not copy it into your own site or product.
Figures and examples shown here describe past work and are not a promise of the same result for you.
Proposals and quotes
Every engagement starts with a written proposal that lists the scope, the price, the timeline and what we need from you. Prices on this site, if any, are rough ranges and not an offer.
Work starts when the proposal is accepted and the first payment is received. A homepage mockup shown before you pay stays ours until the project is paid for.
Payment
Website projects are billed half to start and half at launch unless the proposal says otherwise. Monthly services such as email management and the care plan are billed monthly in advance and run month to month after any minimum term in the proposal.
Invoices are due on receipt. Work can pause when an invoice is more than 14 days overdue. Prices are in Canadian dollars unless stated, and applicable taxes are added.
Your responsibilities
You give us accurate content, timely feedback and the access we need, and you confirm you have the rights to anything you give us to publish. For email programs you confirm that the people on your lists gave consent that satisfies CASL, CAN-SPAM and any other law that applies to them.
You are responsible for the legality of your business, your offers and your claims. We will flag anything that looks wrong, but the final call and the liability are yours.
Ownership
Once a project is paid in full you own the site, the designs and the copy we made for you. We keep the right to show the work in our portfolio and to reuse our own tools, components and know how. Third party assets (fonts, stock, plugins) stay under their own licences.
Guarantees
Any guarantee is the one written in your proposal, with its exact conditions. Nothing on this site creates a guarantee on its own.
Liability
We do careful work, but we cannot promise a site, an email or a campaign will produce a particular business result. To the extent the law allows, our total liability for any claim connected to our services is limited to the fees you paid us in the three months before the claim, and we are not liable for indirect or consequential loss such as lost profit.
Ending things
Either side can end a monthly service with 30 days' notice after any minimum term. Project work can be stopped by you at any time; you pay for the work done to that point and we hand over what exists. Hosting and care plans stop when they are no longer paid for, after a reminder.
Law and contact
These terms are governed by the laws of British Columbia and Canada, and the courts of British Columbia. Questions go to contact@zylosend.com.
